Any punishment will only last as long as Republicans are in charge. The second democRATS return to office, his punishment will be rescinded, back pay paid to him, and meritoriously be promoted to Admiral.
 
I didn't retire from the military but I've been told that once you retire you're not really "retired". You're on the list but they can recall you active duty and if you refuse they can take your retirement.

I remember people being recalled active duty during Desert Storm who were on the retired list.

I'm not sure what the rules are so what I'm about to say might not be relevant.

But if he did his service and retired honorably. They shouldn't retroactively take that away from him. But I'm guessing there is a clause somewhere in the uniform code of military Justice that says that if he behaves in a manner that discredits or dishonors the military they can do that.

That said I bet they could take his retirement pay and he wouldn't even notice it in his budget
 
He didn't behave in a bad manner. He stated what was written in the UCMJ. You DO NOT have to follow an illegal order! PERIOD!!!! The big problem is that the President wanted him killed!! Now, thats a problem. He should be relieved of his office.
 
I don't care if you are angry. Look before you speak, I did. Trump wanted him to be executed. I do believe that means killed, wacked, or however or whatever you call it. I didn't come up with it, it's fact. As a matter of fact I will say that if a sitting President doesn't understand the Constitution or the UCMJ he needs to be schooled and if he still doesn't learn, REMOVED. I voted for the guy but my god he's terrible. Personally if you didn't serve this country and you don't understand the UCMJ you shouldn't be making comments.

So, where was he and his ilk when obama was busy droning Americans and innocent civilians? How about when our sailors were captured and humiliated by Iran? Not a peep out of anybody, especially this azzwipe. Oh, and the commiecrats didn't wish death on Trump, and celebrated the attempted assassination on Trump? And let's not forget how they attacked and discriminated against Military members who objected on Religious grounds against getting the flu shot.
Trump labeled the video as "seditious behavior" and suggested that the actions of Kelly and his colleagues could be "punishable by DEATH." He expressed that such statements undermine military discipline and authority. Well, he is correct. Why is it okay for them to think the Jan. 6 protestors should be charged with treason and punished accordingly, but it is okay for them to tell the Military to perform a mutiny and political coup? And please, don't try to say that isn't what they were doing. That is EXACTLY what they were doing, and nobody has the spine and intestinal fortitude to call them out on it. That whole video was their call for the military to essentially perform a military coup, which IS sedition and treason. So, please, let's stop the wankery. It is getting old.

I guess some people should be reminded of Articles 88 and 133 of the UCMJ. High ranking retired officers don't get a pass and are expected to conduct themselves to higher standards. Some members have me on ignore. Everyone can do their own research and look up those articles themselves. That is if they want to post with any intelligence while trying to defend Kelly.
 
I see you still don't get it. It's not a mutiny. If a person believes that a given order is illegal, no matter who gives that order, the UCMJ gives that person the right to disobey. Just because someone higher up gives an order that doesn't mean it's right, or legal. When the president and commander in chief makes his ridiculous remarks HE needs to be held responsible also.

Everyone is entitled to their opinion. You know the old saying opinions are just like a..holes, everyone has one. I do not care if they are democrat or republican. Presidents should also conduct themselves to higher standards.

[1] Kelly exercised his 1st amendment rights, when he made that statement.
[2] However if any military personnel did what he suggested, what happens to them? Do they not get court-martialed?
[3] When he made that statement in my opinion [which are like a#$holes/everyone has at least 1] he committed a sedition /treason, for that I believe he should be held accountable.
Now I have never been in the military, so that's why [2] is there. Please explain, so I will know.
 
"Trump should conduct himself to a higher standard", BUT, the democrats can do or say whatever they want, without consequence,because that is different. They can incite riots and violence, because they are special and above the law. As long as Trump doesn't speak his mind or criticize ANYBODY, it is all good. They can tell people to "get in their face, tell them they are not welcome here", they can encourage violence, and that is perfectly fine and free speech. But God help Trump if he says ANYTHING that can be construed as "uncivilized." Got it.
 
Remember this is JAN. 6th.Lets not talk about inciting riots. Democrats need to be held responsible also, if not they should get the axe also. There are plenty of them also that need to go.

For your question to number 2. Not necessarily, I have seen orders refused and when the dust all clears the orders were just say highly questionable and persons were not courtmartialed. Just like civilian law most instantances are not cut and dry. Some are but most not. People know the difference between right and wrong and just because someone orders you to do it doesn't make it right. Every instance is different. We were always told if it doesn't feel right ask before proceeding. I spent 23 years in the Army and Air Force. Most superiors were great people but there's always that one you have watch out for.
