MILTON, Fla. -- An 84-year-old Milton woman was arrested after firing a gunshot as an apparent warning to her neighbor cutting his grass, according to an arrest report.

Charlene Davis is charged with aggravated assault with a deadly weapon (felony) and discharging a firearm on residential property (misdemeanor).


The incident happened last Thursday around 8:15 p.m. in the 3200-block of Atlas Drive in Milton.
 
Because they were cutting the grass? Cutting her grass? Cutting the grass after 8pm? IDK she sounds a bit loopy but maybe theres more to the story

I grant you 815pm is unusual and maybe done to purposely be annoying BUT it could be he got off work and wanted to get the lawn cut because he was going to be working for the next several days. My thought is if he was gonna be done by 9PM, Id cut his some slack.

It was probably still light at 815PM and I doubt there is a noise ordinance before 9PM

Im still with LOOPY and angry. Thats a scary combination

Hmmm? Well shes charged with aggravated assault with a firearm. Its hard to imagine the case being Nol Prosed. I dont see her doing any time; but some sort of conviction seems appropriate or at least Stet the case and send her to counseling (?)

In unincorporated Santa Rosa County, Florida, a noise ordinance restricts noise levels to 60 decibels or lower for residential properties between 9:00 p.m. and 6:00 a.m. Violators face a mandatory initial warning, followed by fines starting at $100 for subsequent offenses. [1, 2, 3]


Key Rules & Enforcement
  • Decibel Limits: Noise levels exceeding 60 dB—roughly the volume of a normal conversation or dishwasher—measured at the receiving property line are considered a violation. [1, 2]
  • Industrial Zones: Limits are capped at 80 decibels for industrial properties. [1, 2]
  • Exemptions: The ordinance does not apply to the discharge of firearms. Community events, racetracks, and construction projects can apply for a noise variance through the county. [1, 2]

so he had until 9 PM...could have also been a bad muffler on his mower as well....

maybe go electric/battery..???

My dear old grandma, 4’11” and 90 lbs, born 1894, was an old fashioned southern lady. When her and grandpa moved from Alabama to southern Illinois in 1921 they bought a new home at the edge of a small town. Grandpa worked nights in the mines. Grandma was alone at night with my 5 yr old Dad and 3 yr old Aunt and was a bit frightened. Grandpa bought her an old (1904 vintage) .32 Smith and a box of cartridges, and took her out to shoot. Fired about 3 cylinders full. The old pistol was then loaded and put away in a drawer on the windup Victrola that sat on Grandma’s side of the bed. Us kids all knew it was there, but we also knew you just didn’t go into grandma’s room without permission. Grandpa passed away in 1956, and grandma lived alone the the old craftsman style house. She slept in the front bedroom. Out back was a full width screened porch-about 6’ above the ground. One night in 1984 grandma woke up to the noise of someone on the back porch trying to open the back bedroom window. Most little old ladies would have been terrified. Not grandma, she grabbed her Smith, went to the back door, opened it and fired three quick rounds at the intruder😳. Scared this dude bad enough he dove off the porch, breaking a 2 x2 brace and the screen as he did so. Dad’s cousin who lived across the street called Dad “You better get over here-aunt Minnie’s done shot at somebody. Dad called me (I lived closer) and we beat feet to grandma’s. We also called the local PD. We got there and grandma said “I ain’t having anybody break into my house”. Cop got a big kick out of it, said “I’ll bet he thinks twice before trying to break into anybody’s house after this.” He checked the neighborhood and told grandma he’d be keeping an extra watch for her. I’m looking at grandma’s pistol. The cartridge cases are Green with oxidation and the old lead bullets on the remaining rounds were White😊. That old Smith had set loaded and ready for 63 Years and functioned as required when needed. (If she’d hit the guy he’d have likely had lead poisoning🙄). The next day I cleaned and reloaded her revolver and Dad and I fixed the screens. That old pistol was with her until she passed at 96, and is in my safe now, along with 31 of the original rounds. Not worth anything to anybody but me but to me it’s priceless.
