I’m diving into my first NFA experience. Have a Saint Victor 8.5 that I am going to run in USPSA. I have applied for NFA due to changing to regular stock on the pistol making it a SBR.
Question for you guys is if I put a different upper and barrel (14.5 and pinned comp) bringing it to 16.1 do I need to get a second form 1 to build it? It would become a standard rifle at that point.
 
It may not be a problem, but the best way to cover your rear end is to send that question in writing to the NFA branch office and get a written answer that’s signed by a staff member. If you get it in writing that what you want to do is currently legal then it’s hard for atf to jam you up later should they have a change of heart.

The lower is the serialized part and because it has the fire control system is legally considered the firearm. What kind upper and barrel length goes on it makes no difference once the lower is SBRd.

Once it’s SBRd it’s SBRd. You can go back and forth between barrel sizes as your heart pleases. It doesn’t un-become an SBR. BTW, as per ATF regs you have to get the lower engraved to reflect you as the builder.

There is a process to get the SBR designation removed if - for instance - you decide to sell the gun, but it is a drawn out procedure.

What i meant was, if I buy a pistol with a brace, put a 16" barrel on it and a stock, does it need a form 1 after the change?
 
What I was told by an ATF agent when I first started the SBR process is that and length changes to a registered SBR can be done legally but with the caveat that this is done as a temporary swap. Maintaining the original parts of the SBR to be able to reconfigure it back to its original registered length is the key.

I am not a lawyer and this is not legal advice so please do your own homework on the question and consult the ATF for further clarification and I would suggest getting it in writing. The ATF website may already have the answer on there if you look.

The problem you have is the gun is designated a pistol because of the brace which prevents you having to declare it a Short Barreled Rifle. If you put a stock on it you have to SBR it regardless of the length of the barrel that goes on afterward. The brace/stock change is the issue, not the barrel.

If you’re running a 16” tube, why hassle with SBR at all?
My understanding is that if you change anything at all from a “pistol” designed AR it now needs to be registered under NFA. As soon as it becomes a ”shoulder fired weapon” you are stuck.
