A McMess at a McDonalds in McPolk county Florida

I know there are lawyers here and I know that their cops here and I know that there are people that are much better educated than this than I am but I'm going to give an opinion anyway.

I think there's blame to go around for everybody here.

If they were so swamped with orders they should have closed the drive-thru.

I think it was a bad call on the manager's part. He should have gone ahead and cooked up their order and got them out of there. It wouldn't have delayed the online orders all that much.

Can't speak for Florida, in Colorado if you leave the scene to retrieve weapon and come back you're the aggressor.

What the hell is he doing just leaving a random gun in his backpack at work?. I'll bet you have McDonald's had found that gun they would have fired him.

I'm going to say again, the easiest way out of this would have been for them to serve the guys and get them out of there. If they had that many orders on the grill they certainly could have got these two guys their burgers and got them out of the store.
 
I wouldn't give them nothing! I would have told the punks to get out and called the cops to remove them. If they pulled a gun, that would have been the end of the story for them. No need to back down to punks, Thats the problem these days.
 
Not withstanding Night Rider's points , most of that are things the Manager should have done , and beyond the control of the front line employee , who is the one being threatened , not the Manager .

Yes , l am also in a jurisdiction eager to try to evoke bogus claims of " esculation " . But ( if news reports , and Sheriff's presser are reasonably close to accurate ) , the Shootee & Sidekick were blatantly the agressors , and the one's who brought up guns into the situiation .

The employee made prudent steps to defend from credible threat of armed attack .

The attempted snatch was itself a deadly threat , justified to use leathal force to defend .

Why would he ( employee ) have his Roscoe in his backpack ?

Fla is Permitless Carry . Employee may well wish to exercise his Rights before and after his shift . Maybe in his pack in employee lockerroom was more secure than in his car . Or maybe he rode motorcycle , or bicycle , or lived nearby and walked , to uber'ed , or took the bus .

( If news reports and Sheriff presser are reasonably close to accurate ) , Employee's screw up was in leaving the scene .

I'm not a Lawyer , much less His Lawyer . But an obvious defense ( if true) for the tampering charge would be to the effect of :

He was in fear that additional confederates of those two were about to attack him in rettaliation for shooting their buddy , before LE could arrive . So it was for his safety , safety of innocent bystanders , and to De Esculate to Get Out of Dodge , until the Scene at the McDs was stabilized by LE .

And of course , and that as soon as informed that the scene was secured , he returned , to fully cooperate with LE .
 
Yeah , that too , at least the Fired part .

But cynically , in order to be fired after a workplace gunfight , the first criteria is that you have to be alive to get fired .

And 21y.o. working at McD's , it's not as if he had a generous pension plan and stock options at stake .

Just like certain people , doing a little ( famous ride share outfit ) on weekends as retirement gig to pay for their ammo & range time .

( Company ) doesn't allow drivers to carry for self defense , and ( driver ) don't care . If such a situiation were to happen , being let go is literally the least of their concern .

( Yes , in that jurisdiction , the carry is totally legal , just a matter of ( company ) policy .
