Florida AG threatens to personally sue officials after police ban guns at local festival

Florida Attorney General James Uthmeier is threatening public officials with personal lawsuits after a local police department tried to ban firearms at an upcoming street festival.

The clash began when the Atlantic Beach Police Department posted a notice on Facebook detailing the rules for the “Dancin’ In The Street 2026” event, scheduled for Saturday, May 16. In the post outlining road closures and parking restrictions, the department included a bulleted list of prohibited items within the Beaches Town Center event zone, explicitly stating: “No Firearms, weapons, ammo.”

Florida law strictly prohibits local governments and police departments from creating their own gun regulations, a legal principle known as preemption that reserves firearm legislation exclusively for the state government.
 
I think the problem is with how they are going about it. The city commission passed an ordinance prohibiting firearms at such events. Florida statutes prohibit local government from enacting laws and ordinances that are more restrictive than state laws. The city is clearly in violation.

If it were on private property, guns could be prohibited by organizers with check points, bag checks, magnetometers, etc.
