How Long Do We Think This Will Stand?

Hi

I wonder if this decision will be appealed to the full 9th Circuit court. That might take longer than the weekend. ;) But I suppose a rogue judge could issue a stay until the appeal. So, maybe it will last a week? :LOL:

Well it looks like the 9th circuit already made a decision.
A panel of the San Francisco-based 9th U.S. Circuit Court of Appeals sided 2-1 with a gun owner in ruling that the state's prohibition against open carry in counties with more than 200,000 people violated U.S. Constitution's Second Amendment right to keep and bear arms.
Not to mention they've (California) already shot themselves in the foot.
California itself allowed citizens to carry handguns openly and holstered for self-defense without penalty until 2012

I confess that I'm not familiar with the difference between decisions made with a three judge panel and the full court. I'm sure we'll hear of any new developments. ;)

No , the Nineth * Circuit * has not made a decision , just the 3 Judge Panel .

Overall , Full Circuit Reviews are quite unusual .

Except for 2A cases.
Especially in the 9th .

In recent years , every 2A victory in the Ninth was given full circuit review , and overturned .

The Ninth is the largest Circuit , with 29 Judges , the majority decidedly anti gun . But the system for assigning judges to 3 Judge panels is pretty much true random , and from the odds will occasionally assign two Constitutionslist Judges to the same panel . But the Progressive majority won't put up with that .

The Fourth also indulges in Full Panel Do Overs . Recently they invented an unpredecedented manuever .

When they realized the 3 Judge Panel was writing up a 2A favorable ruling , the Full Circuit snatched the case away from them , before the Ruling was published .
