IL sued over FOID Law

The New Civil Liberties Alliance (NCLA) filed a lawsuit against Illinois officials Tuesday over the state's Firearm Owners Identification Act, also known as the FOID Card Act, a state law that requires Illinois residents to apply for and carry an identification card at all times to possess any firearm or ammunition.


 
It does sound an awful lot like some guy in a long black leather coat saying "Show me your papers".

Im assuming the demand for ID is only once they have reason to believe you are armed OR is it that they now want to be able to approach anyone and demand identification?

They run my drivers license or plates and they know right away. Pointless 6 dollar card.
 
Do they know because of the card OR because the purchase is tied into the DMV/NCIS? If the license check say you own firearms can they demand to search if you say you arent carrying a gun today?

The FOID card is issued by the state police (a background check before going buying a firearm). When issued it gets attached to the DL or state id along with the license plate of the vehicle(s). I got a card saying I was ok to go buy but will get another background check every time I go buy a ffirearm.
 
Been a long standing Illinois issue going WAY back-I’ve been gone 40 years and we had FOID for years before I left. Total bs harassment, esp in the days of the auto background check the feds run on all purchases.
In Maryland you are required to have a HQL (handgun qualification license) card to purchase a handgun AND if you want to buy two handguns in a month you need to have a collectors license AND you can only buy handguns on the "approved list". Its been in effect for 20+ years, so now people just expect it like its normal

I know Illinois is annoying but that is wrong.

Certain individuals , and certain handguns are exemempt from HQL .

W/o Designated Collector status , you Can purchase Two handguns , at same time , and then have 60 day until next one .

1966 - 7 Day Wait , and State Police aporoval for each Handgun * Transaction * . ( In 1980's " 7 days " typically took 2‐3 weeks)

Late 1980's - Handgun Roster .

( Compressed for space - Various 1990's laws 20 rd mag limits , One per month , and all Handgun transfers must go thru State Licensed Dealer . A couple of different Bans of certain Evil Black Firearms , and remaining subject to " handgun purchase process " .)

2013 - Creation of HQL , 10 round mags ( with astrix ) , Ban most of not yet Banned Evil Black Rifles . Plus a bunch more fine print stuff .

2022 - All Longgun transfers must go thru FFL , with narrow exceptions .

More recently - Post Bruen Hissy Fit . Not California level expensive , but make carry permit more complicated and expensive , +/- $500 total expendature .

Plus make almost everywhere No Carry under penalty of law . The State Level 2A Org got Injunctions against the worst of them , and Litigation is ongoing .

But the distinction of HQL vs FOID , is HQL only applies to the Purchase of most Modern Handguns .

FOID applies also to Posession of Any Firearm , or Any Ammunition .

As long as you don't purchase an additional handguns , you can let the HQL expire , with no effect . FOID must be kept current , to continue to posess what you already own .

One thing about a CCL is it automatically updates my FOID but I still don’t like the fact Illinois does what it does
 
Used to be a separate license was issued for a CCL. Now it's tied to the foid card. Little bitty yes in the upper right corner, that i can't even see without a magnifying glass. Plus no printed expiring date. Stupid!
