SUMMARY:

Federal law permits federal firearms licensees (“FFLs”) to transfer firearms to a person residing in the same state but who does not appear in person. These are “non-over-the-counter” (“NOTC”) sales. The Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) proposes amending Department of Justice (“Department”) regulations on NOTC sales. These proposed changes would remove restrictions limiting this option to background check-exempt transfers. The proposed rule would permit FFLs to conduct NOTC transfers while complying with background check requirements and adds remote identity proofing and electronic notices to chief law enforcement officers. These changes would provide greater flexibility for individuals lawfully purchasing firearms.

Hi,

I have not yet decided how I feel about this new rule. I'm comparing the process to mail-in ballots, how easy those are to corrupt and manipulate. I don't mind going to the store and paying my transfer fees there. They appreciate the business.

Will this mean that the delivery driver will get a signature, check the ID, perhaps NOT deliver if he feels something is out of place? Will this put the delivery drivers in any kind of danger? Will porch pirates have a field day? Will local law enforcement check to see if the firearm was delivered to the proper party? I'm gonna hafta hear more about this rule and how the procedures will change the security ramafications.

Thanks for including a link to the proposed rule. I'm trying to read through it. The "remote identity proofing" procedure has me a little concerned. In the text of the rule it states, "U.S. Citizenship and Immigration Services, for example, allows employers to remotely verify I-9 documents establishing eligibility to work." I wonder if that has ever been abused. Surely not. (Yeah, right.)

Who's to say that some felonious serial killer won't steal the ID info from a law-abiding citizen and have an arsenal delivered to his gang house?

So, for now, just color me skeptical.
