Sbr question.

I picked up a Scorion 3+ pistol.
If I choose to fill out a Form 1 and make it an SBR I know there is a laundry list of regulations.
My question is if I choose to turn it into a SBR can my wife use it in a home defense situation?
Furthermore, for her to use the SBR ,it would require her to train and become familiar with the firearm.
Is she prohibited from ever using the SBR in a home defense situation and may she train with it at the range?
I’ve never been down this road and wondering if I should just keep it a handgun if both of use will be using it.

Please note that I am not a lawyer and what I post below should never be taken as legal advice.

Any NFA item should never be in the possession of someone other than the registered owner of said NFA item unless the the registered owner is present. Using the SBR for self defense should not have any legal effect on a legal self defense encounter, but there would most likely be a federal law broken by the person in possession of the NFA item if that person is not the registered owner.

If you put the NFA item in a trust and add your wife to that trust you can avoid a lot of legal hassles.

An NFA item, whether machine gun, SBR, SBS, or any other weapon must at all times be under the "control" of the registered owner. If you are at a range, anyone can hold it or shoot it aslong as you are in the immediate area. Don't go off to get a sandwich and leave it with anyone.

I’ve got so many Form 1’s from the ATF for the trust. It’s sooo super easy.

Only legal authority who can check for SBr or form1 is the ATF or IRS.
Local/state dont have jurisdiction
They have to call feds.

Now, it would be probably good practice to provide them when asked by local as to not have them call feds and go down a rabbit hole of attitude

When you go the trust route, make sure you proof read your submission answers. Name, DOB, name of other trust members, name of your trust you made up .. etc,,
Like re read it 5 times.

Once you hit submit, any mis spellings are now your trust.
Changes are 😱😱😬😬😬 fubar.

All kidding aside.
Sounds like it might be easier to create another trust.

I’ll be working on this today.
Just tried calling two
Local attorneys that specialize firearms law and both are too busy to take it on right now.

Go the online route..

Its super easy. Print. Take to Notary. Done. Legal and ATF accepts them all day long. All my buds have used it for years as well . Prob know 15 people that have it thru them

Remember when you get the elec finger prints from a local shop, to have the wife set of prints done as well
 
Does it matter the dollar amount I use to fund the trust?
1-100 bucks
