What Does the Castle Doctrine Defend?

Bottom line, there are three standards for a defensive shooter, one for LEO's, one for wealthy civilians and one for everyone else; and just a reminder, being scared may not cut it, where you are really matters, rural, urban, political flavors, education levels of jurors, age of defendant and jurors all play to your chances. I'd rather use a firearm as a club before I use it to shoot, but if that's what it really takes to save my life, so be it.

Yet another reason why 2A and self-defense laws should be Federal (Supremacy Clause) and there should be zero room for States to make up their own interpretations (unless Federal law is trampling Constitutional protections). One should always know exactly the potential consequences of decisions they make without having to consider 50 different potential consequences. To make it worse, there are jurisdictions within States that try to make the minutiae even worse - for example, in Texas, there are a few urban areas (Houston, San Antonio, Dallas/Ft. Worth, Austin - and I’m sure I missed as couple) where there is zero concern for rights of US citizens whilst protecting non-citizens ad nauseam.
 
lotta good people in those urban areas but all of their leadership are headed down the woke road...I'm fortunate to have never lived in an urban area and will defend west Texas on it's way of life....check out Lubbock on the castle doctrine and Amarillo
 
Florida does not have a Castle Doctrine by name. The justifiable use of force law says that you are presumed to be in fear of death or great bodily harm frome someone who forcibly enters your domicile or occupied vehicle provided they have no legal right to be there. The statute also presumes that a person who forcibly enters is presumed to be doing so with intent to commit a violent felony. My sheriff also suggests that we shoot home invasion burglars to save the county taxpayers money.
 
Very good information, we have Castle Doctrine in ND that covers our home and vehicles.
It's for the "what now?" question that I'm a member of AOR! I hope that I never need them but in this day and age I want them for my legal team if heaven forbid I'm ever in a self defense situation.

I think it is one size fits all. You come into my shack uninvited in the middle of the night, your next of kin will be notified. It is that plain and simple. I do not agree with, nor will I comply with any duty to retreat nonsense. You come into my home and I get to a defense tool before you get to me, you're gonna die. If you want to arrest me for defending myself in a manner I saw fit, in my safe place, bring the judge and jury with you because this is where it's gonna go down and only one of us is gonna walk away.

Depending on the facts, the castle doctrine may or may not be applicable.

It is very much a case by case-by-case basis. And a jury may not agree with your interpretation of the circumstances.

While i agree with you that a jury may not agree, and that local or state laws may directly conflict with my opinion, I stand by my words. I will defend myself and my loved ones inside of my home in any manner I see fit. If you are law enforcement, and you are a subservient weakling wishing to uphold your lily-livered, man bun sporting, or woman with a wife governor's beliefs, and you think you're gonna take me in after I defend myself? Yeah, as I said before, you'd better bring the judge and jury with you because I absof'inglutely guarantee you I will NOT end up in cuffs. One of us is leaving in a meat wagon.
 
Here, if they are in your house you can shoot them whether they are armed or not. same as with your car, it is considered a domain here. if someone breaks your window and try to open door they are legal to cap.

I'm still heavily leaning towards moving to yer neck of the woods. Are those mosquitos big enough to hunt n eat?
 
I wouldn't be posting any blood thirsty answers here or anywhere. Sign: Forget The Dog Beware Of Owner. I know of one case that the Owner wished he didn't have this in his yard.
