Breaking News: Supreme Courts strikes down law banning habitual marijuana users from owning firearms

Guys, it's a limited opinion upholding the Fifth Circuit’s decision that § 922(g)(3), unlawful possession of a firearm anyone who is an unlawful user of or addicted to a controlled substance, was unconstitutional as applied to Hemani. Hemani has US and Pakistani citizenship but was born and raised in the US. He and his parents were investigated for terrorism related activities; and, during the search of the house, officers found marijuana—which Hemani claimed and said he used regularly—and cocaine—which he also claimed but said he hadn’t used recently. Hemani also surrendered a firearm he had in the house. Months later, Hemani was indicted in federal court under 922(g)(3) and only for that charge.

The Court applied Bruen’s “test” to decide that historical analogues to § 922(g)(3) were not similar enough to salvage.

The Court stressed that because it was never alleged that Hemani was an addict, that the decision did not address the aspect of 922(g)(3) dealing with addicts. Nor does it consider how it might apply to people “presently intoxicated.” It also stressed that this decision should not be seen as casting doubt on any other aspect of § 922(g).

While this is definitely good for Hemani and may well help some people—§ 922(g)(3) is rarely charged as the Court noted—I wouldn’t bet on this decision being particularly useful for challenging anything other than situations where someone is charged with violating § 922(g)(3) for possessing a firearm while occasionally smoking pot. Don’t count this applying to other drugs since the Court referenced the fact that pot was changed from schedule I to schedule III this year.
 
I came to see all the anti gunners pretending to be pro 2A who don't like this decision and would rather millions of gun owners be disarmed for life because of their personal ridiculous vendetta against smoking a plant flower. I guess FUDDs are going to FUDD. The good news is they're dying off and the country and the younger generation on both sides of the aisle are progressing with regards to this topic in general.

Im sorry how does not wanting someone who cant make it through life without clouding his brain and who knowingly violates the law be allowed to have a gun, make me an anti gunner?

Nope. The only reason I switched to a pipe from cigarettes is because coffin nails went to $1.00 a pack and pipe tobacco was cheaper. Ya I've been smoking a pipe a long time. ;)
Nicotine is a very addictive drug. By your logic, you too shouldn't have access to firearms as you are an addict.

I've seen the significant (positive) physical effects of weed on a patient in need. I was married to one for 27 years. Now divorced, I had no qualms about sending her off with her pistol, knowing she would be a SWF in an apartment complex on her own, no one to protect her should something occur. I also appreciate the challenge of this issue for us 2A folks.

In short, I don't disapprove of the court decision....but I understand both sides. It is NOT a black and white issue.

Regarding "Reefer Madness" and the concept of "gateway drugs", I'm not a buyer of those philosophies. I've seen in real life someone use for decades (weed) and not progress to harsher drugs.
 
As a retired LEO and 60 years of shooting, I reiterate, weed don't cause the issues that alcohol can and will.
Ever investigate a drug related crash? Ever make driving while high cases? I ask because I have. Ever take a DRE (drug recognition expert) course again I ask because I have. We dont need another intoxicating substance being OK'd for use. The fact remains that every place that has legalized pot, has seen a rise of driving while high.

We had a customer try to buy a gun during the early defund craze. She admitted that she had been using pot for 30 years and now had a medical card for it. She was using it because she was in a motorcycle accident 30 years ago. She said every time a motorcycle goes by she gets so upset she can hardly get by without the pot. SORRY thats not the kind of person I want with a gun. What it sounds like is a person who needs mental health help and or a doctor that failed her

Seems to me Pot like Oxy, is a drug handed out by lazy doctors without any real concern for the patient, except to move them on for the next co-pay waiting in line. And like Oxy its being pushed by folks with $$$ to make more $$$ at the expense of a I wanna feel good public. Some how I and a lot of folks like me managed to avoid pot and illegal drugs and get through the stresses life tossed at us

Id go a step farther and link pre teen cigarette smoking as the gateway. Its the even though illegal, "Its not so bad" thinking. Today we have so many parents with the "its not so bad" mentality that its transferred to the kids and the pot begins even earlier. Oh and hey the where the F did the bath salts (et'al) start if it didnt have something that lead to it. Its an attitude and there will always be the weak that follow the "it feels good" path.
