Another self-defense shooting in Florida

A lot of people in Florida would agree with you, but then there is the law. We'll have to see how it is applied here.
Key Requirements
Lawful Presence: The individual must be in a location where they have a legal right to be. Trespassing or being in a restricted area disqualifies the defense

Not Engaged in Criminal Activity: Stand Your Ground does not apply if the person is committing, attempting, or escaping after a crime

Reasonable Belief of Imminent Threat: The threat must be immediate, and the force used must be proportional to the danger

Not the Initial Aggressor: If the person provoked the confrontation, they generally cannot claim Stand Your Ground, unless they clearly withdrew and the other party continued the attack

According to a witness, his white SUV had briefly blocked a woman from pulling into a space. At some point, he moved his vehicle, and the woman was able to park.

But the exchange was not over. The woman got out of her car with a phone in her left hand and a gun in her right. DiGuglielmo walked toward her.

Video captured by a witness on a cellphone and a nearby Tesla's dashcam shows what happened next. The woman pointed the gun at DiGuglielmo and told him to "walk away."

Seems to me she is missing 2 of the criteria to qualify under Stand Your Ground
 
Both of them practiced 110% stupidity.

In my current jurisdiction , with standardized Jury Instructions , and prosecutor attitudes , she'd be trying to make a plea for Manslaughter instead of 2nd Degree Murder .

In Florida , with their Statutes ? She's shaky on the line , and could go either way .

Id love to hear the actual audio (better yet the video/audio) on that, I can imagine that with different tones being anything for (pleeeeze) walk away to (M Fer) walk away to (Cracker) walk away to walk away (or Ill pop a cap in your White ***)

What anyone says later will never be what was said at the time, especially after an attorney gets involved and helps her remember how/what she said
