DOJ Says Machineguns Not Protected by 2nd Amendment and Silence of Gun Groups is Deafening

Let's examine this further in the original Wa Times article:


First, according to the article from two weeks ago, gun groups did react as we would expect. I.e, the Trump admin took heat on the DOJ statement.
Second, Judge Carlton Reeves of the Southern District of MS, ruled in favor of the defendant and said the law restricting his use of a fully auto weapon violated the 2A.
Third, Jennifer Case filed a brief on behalf of the US attorney in southern MS (why? Couldn't he do it?) to the Fifth Circuit Court of Appeals. It seems she is telling the US atty it's her project now.
My view: This is a work in progress and we'll see how Bondi and Trump react to this crap. Judge Reeves seems to have nailed the 2A considerations of the original case.

The fact that any of you are surprised by this is really kinda amazing.

This administration is not Pro2A; never has been, never will be. Sure, they might toss out a few crumbs from time to time…but substantial change? Not happening.

At least they won’t do anything to make it worse. Which is more than I can say for the other option available… 🤷‍♂️

I knew not to count our chickens before they hatched, just didn’t figure this crap would happen this time around, guess will have to wait and see…..

True and I knew it coming in, but then the same can be said for pretty much every administration in our lifetimes. And I agree with @uspatriot1960. It's still better than the only other choice we had. At least from a gun control POV.

I had and expressed here, reservations about Pam Bondi. Not that this article is a direct reference to her, just pointing it out. I'm under no illusion that ALL government actors wouldn't really rather we were all unarmed subjects.

The left definitely has started a war on definitions and language. “Assault Weapons” and “Weapons of War” are no where near accurate descriptions of firearms available to the general public. But because of the use of these words, most people think AR15s are fully automatic machine guns used by the military. It’s disgraceful.

I agree, not a direct reference. Case previously represented the US Gov't in the southern district in US vs. The City of Jackson, MS over unsafe drinking water on behalf of the EPA. No one jumps on this 2A case unless it's perceived that the district US attorney or higher up (Bondi) will look favorably on this appeal. I will still wait and see if Bondi or Trump alters course on this.

The Hughes Amendment was passed and added to FOPA as a literally “11th Hour measure” to add a “Poison Pill” to the bill so Reagan would veto it, since FOPA, for the first time in the history of federal Firearms legislation actually COMPLETELY Benefitted Gun Owners.

It was passed in the middle of the night via voice vote (Which, if one watches the video record, shows it did not in fact, Pass). Reagan had EVERY intention of vetoing FOPA and sending it back, but was encouraged by people like NRA and the Republican Sponsors to Sign it into Law, and they would go after Hughes afterwards, which of course, they ALL reneged on.

The transcript had been available for years, but was really inconclusive. it wasn’t until the C-span Video was finally obtained by an attorney on the late 2000’s (20+ years after the fact) that the irregularity of the vote and tally was discovered.

There were attempts to approach several congresscritters to get an inquiry started, but nobody wanted to stir the waters on something that affected so few people.

There are somewhere between 175, and 225,000 transferable MG’s in the registry, nobody is really sure of the actual number since, the NFA stamp is a tax, the records and registry are not obtainable through FOIA, plus, there was a decided effort by some wealthy individuals who saw their multi-million dollar collections being devalued to not rock that boat.
