with Texas not being on the list i'm surprised it's not. now if the hpa ever goes into effect along with the no nics that would be a step in the right direction.

Texas is on list (the one at bottom).
 
Let’s say a husband/wife (boyfriend/girlfriend) are breaking up, maybe she calls the sheriff, reports an abusive situation, she gets a PFA (protection from abuse ), perhaps ex parte and a final order later, and who is responsible for getting his pistol permit from him? Or his guns? Or do we rely on the court to order the sheriff to flag his profile in the pistol permit database?

If the LGS isn’t checking the NCIC, what’s to stop him from walking into the LGS and buying another gun? Because my LGS doesn’t call the SO for every gun purchase.

Just some things to think about. Or maybe not.

In North Carolina in domestic abuse which results in some form of “judgment” your concealed carry could be revoked. Serving officers can demand at time of notice or they have 48 hours to surrender.

If the person uses the revoked CHP (in NC it’s specific handgun) to purchase they face criminal penalty.

I know this doesn’t stop people from doing it and bad things can happen, but then we are getting into the area of bad people are going to do bad things regardless of guardrails.

This doesn’t do away with a background check you just are doing it not as frequently. Every 5 years when you get a background check for your license is checking that box.

Where this comes in handy is for those folks that keep getting a delay for whatever similar name etc etc.

A pro 2A attorney here who represented Eli Dickens and has been involved in our states self defense immunity bill while we have a lifetime has suggested for those folks to get the 5 year permit since it qualifies to be used in leu of a background check and the lifetime apparently does but according to his radio show.m this week.

 
I can walk in and out of an FFL here in Texas with a brand new gun in under 15 minutes. The longest delay is while they double check the 4473 paperwork.

lgs is pretty quick 15 to 20 minutes,
my last trip to academy sports was light speed compared to other times
everything was done and i just had to fill out the digital form 4473,
longest part is the walk to the front where they had off the item..
might have been as i had just picked up one item week earlier

trying now to find a trp 45 1911 for our birthdays next month, matching pair one serial number off

Think about it.

Friday night. Guy gets in a fight, arrested, charged with assault, bonds out Saturday, and can still flash his pistol permit on Monday, buy a gun and walk out of the local gun store? What might go wrong?

Unless there is some way that his background is scrubbed, or his permit is confiscated, I just don't think a permit gets it.

So in this scenario the individual with a concealed carry permit doesn’t already own a firearm and on the same day he receives it he gets into altercation and the events unfold?
 
And should he have his rights revoked because he’s charged with a crime? Current law says you’re not restricted until you’re CONVICTED of a felony. In your scenario, he can still legally purchase a firearm.

Good counter-point. You got me on that. But I think failing to run that background and just taking someone's permit and looking at it and making a sale is not a good idea. Folks can have a permit, sell their guns, get in trouble, and use that permit to go buy another gun, OR just get their hands on a firearm and bypass all the checks and balances.

At a minimum, I like the idea of an NCIC check. And as a lawful gun owner and enthusiast, I am not opposed to that background check.

i can see the possible irritation that other lawful enthusiasts that have check return flagged even though it shouldn’t such as a charge being dropped, inaccurate date etc. no idea the instance of either situation occurring so it’s a 🤷‍♂️

As it affects me, I’m not opposed to the check, as mentioned mine came back almost immediately
